One of the responsibilities as a paralegal is to conduct research. There is a list of basic and useful resources for practitioners and law students to utilize in researching a bankruptcy. The primary sources are Statues, Rules and Cases. The secondary Sources are Bankruptcy Treatises, Internet Sources and Research Databases also known as Bankruptcy Reporter Systems. All these resources are relevant to explain the process in which each is needed to research bankruptcy issues. A statute is a codification of a law passed by legislature enactment and approved and signed into law by the executive branch of the government. These statues serve as source for answering all bankruptcy questions in the Bankruptcy Code itself by plainly finding the right Code section. The Bankruptcy Code defines the rules that collect and distribute the assets to creditors in a bankruptcy proceeding. The Code is well indexed, to start researching any bankruptcy issue. Careful reading, analysis and interpretation are the most important instruments to carry out an effective research. At the end of each code section, there is â€Å"Historical and Revision Notes† that are helpful in explaining the meaning of a particular provision and also a valuable secondary source to locate answers to bankruptcy questions. The two primary sources in the law library for the U. S. Code in print are United States Code Annotated (USCA) which was published by Thomson West and United States Code Services (USCS) which was published by LexisNexis. Both the USCA and USCS provide and include annotations of cases and articles. The online Statues widely used are in the Cornell University Law School, Lll/Legal Information Institute. Rules of the court are rules created by the highest court that govern court proceedings. Cornell University Law School, LII provides a link to information about the Interim Rules and Official Forms for the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005. These Rules of Practice and Procedure in bankruptcy commonly known as the Federal Rules of Bankruptcy (Civil) Procedure and Federal Rules of Evidence clarify the collective rules which are regulating the collection and distribution of assets to creditors in a bankruptcy proceeding. For example, instructions on what form is required, how and when a motion is filed, how and when a claim is filed, and the â€Å"how to† questions and so forth. USCA and USCS found in the law core collection have bankruptcy rules in volumes following the Title 11. Attached to the Federal Rules of Bankruptcy Procedures are forms called â€Å"Official and Procedural Bankruptcy Forms. † These forms present direction as to the content and appearance of the documents. In addition each Bankruptcy court makes its own local rules and local forms as long as they are not inconsistent with the Code or the Bankruptcy Rules. Local rules vary from district to district and can sometimes be the source of answering a practice or procedure question therefore; each federal District Court has its own Local Rules of Court, including United States Trustee Guidelines. Both The Federal Rules of Civil Procedure and the Federal Rules of Evidence apply in bankruptcy proceedings but not all these rules apply to a bankruptcy case. Another primary source for paralegals to perform research is case law which is the law established by the outcome of former cases. There are several reporter systems that publish only bankruptcy cases. We can find cases online in LexisNexis Academic and Westlaw Patron Access. Collier also publishes a reporter system called Collier Bankruptcy Cases (Law Core KF1524. C62 1979). The largest reporter system is called West’s Bankruptcy Reporter (Law Core KF1510. A2 W47) and there’s also West’s Bankruptcy Digest (Law Core KF1510. 3 W47). All these reporter systems hold cases decided by Bankruptcy Courts, district courts, courts of appeal, and the Supreme Court that relate to bankruptcy issues. Another system which is acceptable to cite is called Bankruptcy Court Decisions (BCD). In addition, the bankruptcy system uses its own separate treatises. A treatise is a written extensive essay of facts and principles and conclusions. The most common resource used is Collier on Bankruptcy and they follow up with practice forms and guides entitled the Collier Bankruptcy Practice Guide. They consist of sample pleading forms and additional practice tools. These primary sources of researching bankruptcy issues start from codes and follows all the way to reporter systems and online. The internet by far has simplified the time of research in its entirety. Transferable Personal Skills Development

Transferable Personal Skills Development Introduction: A better definition of transferable skills would include a wide range of different skills that are not only useful for a wide range of jobs, but will also equip students for a productive career as a research scientist. Critically evaluating data; being able to write clearly and effectively in a range of styles; communicating via formal presentations or the media; networking and managing your time effectively are skills that are useful in many different jobs. Building a core competency in these areas will also certainly make you a better scientist. It is also important to recognise that your role as a researcher will change dramatically as you progress from student, to research assistant and beyond. In this respect learning about the process of getting published; how to write grants that will get funded and how to manage finances and lead teams of scientist are all indispensable in smoothing the transition to become a Principal Investigator or PI. Although these might not seem to be the most transferable of skills, the everyday activities of a PI are so radically different from a student who works at the lab bench that it is effectively a completely different job. We are social animals and need the input from and interaction with others to function effectively as individuals. One of the most significant ways in which communication can influence individual behaviour is through its ability to change individual perceptions and perceptual bias. Transferable skills are important skills which individuals should possess, not only for the purpose of academic programmes of study, but also for that of operating effectively within ones job role in the workplace. Transferable skills can be seen to be that which are somewhat fundamental skills which benefit individuals with the task at hand. A good example of this is the ability to work well in a team- this is something which is important both when studying and having a job. Case study: PDP is a process of reflecting and recording my experiences to help me to make the most of my time at Guildhall. It provides a range of specific, targeted techniques that I can use to: gain new perspectives on my studies, career and life in general monitor and record my talents and achievements identify goals and plan my term-time study workload and/or my future career help me present my skills and accomplishments to prospective employers. The outcomes of PDP should be: greater understanding of how much progress Ive made in all areas of my course better understanding of my strengths and weaknesses by both me and my Tutor clearer understanding of what I need to do next agreement on setting goals and targets an action plan that summarizes all this. My academic studies, whilst being the primary part of my experience at Guildhall, are not the whole package. Some of the most significant changes Ill encounter will be in the area of personal development. My horizons geographical, cultural and intellectual will be broadened by the experience of studying in Guildhalls international environment, and by the extra-curricular activities and opportunities you choose to pursue. If this is my first time away from home, living and studying in Guildhall will encourage me to be more independent, self-confident, and resourceful, better at managing my time and your money, and better at working with others. In a word, more mature. If I are a mature student, I am already likely to have some experience of skills mapping, reflective practice, learning styles, career planning, CV and interview technique. The decision to return to education may have been step one of my career plan. It is still of benefit to reassess your goals from time to time. Very simply, acquiring basic competency across a range of transferable skills will make me better equipped for any career you chose to follow. Unless you are naturally gifted at everything you do, everyone can benefit from some well structured and focussed training courses. Its also clear that gaining a range of transferable skills is important in finding your next job. Several surveys of employers have found that although PhD graduates were technically proficient, highly motivated, and resourceful, they needed additional training on soft skills such as working in a team, communication, and career planning. Learning Outcome: If I say something about myself two years before I have come to London for studying with the different people in a different environment. At the begging time I had less able to communicate with the other countries people and another thing is that education system is different. Day by day I am trying to develop my communication skill. Besides, I am working a part time job in the Burger king which is most popular fast food shop in the Europe. I started there as a sales assistant. I have to communicate with the various kinds of customers. I have to manage so many situations. After few months later I become a Supervisor. I have to manage all my staff, ordering the delivery, receiving the delivery, managing the worst situation. So I can say communication skill and time managing those are the two most affect full transferable skill I have achieved to get the success. Always I try to attend in my class in time and my work place. That is why I can get the entire lesson in the class and I got the reputation in my work place because of time maintaining. I never be defocus depending on time management. Another thing is that for my well communication skill I can discuss about my study with teachers and my class mates as well as I can manage my all the staffs and the customers in the shop. Conclusion: In addition to these good reasons for spending some time acquiring transferable skills, I will also find that they are an important topic at the Institute. Acute Eosinophilic Pneumonia (AEP) Caused by Clomipramine Clomipramine-induced acute eosinophilic pneumonia-like syndrome leading to acute respiratory failure: a report of first described case Drugs are well-known causes of eosinophilic lung disease and patients with drug-induced eosinophilic lung disease can have variable clinical presentations. Clinical features may range from asymptomatic eosinophilic infiltrates to acute eosinophilic pneumonia (AEP)-like syndrome leading to acute respiratory failure. This report describes the first case of clomipramine-induced AEP-like syndrome causing acute hypoxemic respiratory failure which was treated successfully. In conclusion, considering the increasing use of tricyclic antidepressants, physicians should be aware of this very rare and life-threatening complication of clomipramine. KeyWords: Clomipramine, acute eosinophilic pneumonia-like syndrome, treatment INTRODUCTION Many drugs have been associated with pulmonary complications of various types with an increasing number of the therapeutics. Respiratory system is a target for a variety of drugs because of its large contact surface and acting as a metabolism site for drugs. The patterns observed in drug-induced pulmonary toxicity are highly variable and depend on the localization of adverse reaction. Since most of the drug-induced pulmonary toxicities involve the lung parenchyma, the most common form of drug-induced lung toxicity is interstitial lung disease (1). Drugs theoretically can produce all histopathological patterns of interstitial lung disease, including hypersensitivity pneumonitis, organizing pneumonia, bronchiolitis obliterans organizing pneumonia, acute respiratory distress syndrome, granulomatous pneumonitis, and eosinophilic lung disease (2). More than 350 drugs are known to cause acute eosinophilic pneumonia (AEP)-like syndrome (3, 4). However pulmonary complications related to tricyclic antidepressants are uncommon. To our knowledge, only one case of AEP associated with the usage of clomipramine has been reported in PubMed in 1999, and in the aforementioned case clomipramine had been used not alone but with sertraline (5). This report describes the first and successfully treated severe case of AEP-like syndrome associated with clomipramine treatment alone. Written informed consent of the participant patient was obtained for the publication of this case report and any accompanying images. CASE REPORT A 38-year-old female was referred to our clinic from psychiatry department of another hospital. She had been newly diagnosed with panic attack and anxiety disorder one week prior to the appearance of respiratory symptoms. After admission to psychiatry polyclinic, clomipramine therapy was prescribed at a dose of 75 mg/day. After 6 days of clomipramine therapy, the patient exhibited dyspnea, increasing shortness of breath, dry cough, chest pain, and fever up to 39.20C. She was a housewife and had no work-life history. There was no past history of a chronic disease and her smoking history was 16 packs/year. She had never consumed illicit drugs, had no allergies, and had not visited a foreign country during the previous 5 years. On admission, the patient was in a respiratory distress, with a respiratory rate of 35 breaths/minute, a blood pressure of 110/70 mmHg, and a heart rate of about 140 beats/minute with sinus tachycardia. Examination of blood samples revealed only anemia (haemoglobin:9.4 g/dl). Number of leukocytes, thrombocytes, and results of blood chemistry were within normal limits. Erythrocyte sedimentation rate was 40 mm/h and serum level of C-reactive protein was 4.5 mg/dl. Measurement of arterial blood gas analysis on room air revealed pH: 7.44, PaCO2: 32 mmHg, PaO2: 49 mmHg, HCO3: 27 mmol/L and SaO2: 86% which was compatible with hypoxemic respiratory failure. Laboratory results including HIV testing, serological screening for vasculitis [autoantibodies to deoxyribonucleic acid (DNA), double stranded DNA, proteinase-3, myeloperoxidase, rheumatoid factor, and circulating immune complexes] and various pulmonary pathogens were negative. Stool tests for ova and pulmonary parasites were normal. The level of total serum immunoglobulin E (Ig E) was within normal limits (65 IU/ml) and antigen-spesific Ig E against Aspergillus fumigatus and Candida was negative. Her chest radiograph revealed a homogenous dense shadow located especially in the lower field of the right lung and some additional reticular opasities in the lower zone of the left lung (Figure 1). Computerized Tomography (CT) (Brilliance; Philips Medical System, Eindhoven, The Netherlands) of the thorax demonstrated patchy areas of ground-glass, thickened interlobular septae and homogenous consolidations with air-bronchograms especially in the middle and lower zones of the right lung (Figure 2). The patient was admitted to the intensive care unit because of the need for non-invasive mechanical ventilation. She underwent bronchoscopy (Aquilion; Toshiba, Tokyo, Japan) with bronchoalveolar lavage (BAL). During the bronchoscopy procedure the bronchi appeared inflamed and contained increased secretions. Gram stain and cultures of the bronchial washings did not reveal any infectious organism. Total cell count on BAL was 182 cells/mL with 30% eosinophils, 8% neutrophils, 55% macrophages, and 7% lymphocytes. Special stains and cultures for mycobacteria, Pneumocystis jiroveci, fungi, Legionella pneumophila were negative. Serology testing for cold agglutinins were negative. Intravenous methylprednisolone 60 mg/day (1 mg/kg/day) was initiated on admission. Then dose of the methylprednisolone was gradually tapered and methylprednisolone was discontinued after 4 weeks. The chest radiograph of the patient cleared markedly within 15 days of the treatment (Figure 3). The patient was discharged 18 days after admission. Follow-up examinations one and four weeks after discharge revealed normal laboratory results and a normal chest radiograph. Pulmonary function tests 3 months after admission showed no ventilatory defect. Last contact with her was a polyclinic visit for control one year after discharge and she was free of respiratory symptoms. DISCUSSION The eosinophilic lung diseases are a heterogeneous group of pulmonary disorders characterized by increased numbers of eosinophils in the airway or lung parenchyma, and drugs are well known causes of eosinophilic lung disease (6). Patients with drug-induced eosinophilic lung disease can have variable presentations, ranging from asymptomatic transient eosinophilic infiltrates to AEP-like syndrome leading to acute respiratory failure, depending on the drug involved. AEP is described as a clinical entity which involves acute onset of symptoms within ≠¤5-7 days, fever ≠¥37.20C, hypoxemia, bilateral alveolar or mixed alveolar and interstitial infiltrates, and lung eosinophilia (percentage of eosinophils ≠¥25% in BAL and/or predominance of eosinophils in open lung biopsy). In addition, without any history of hypersensitivity to drugs, no evidence of infection, and no other known cause of eosinophilic lung disease (7, 8). Similarly, patient in this case had newly onset respiratory symptoms, fever and mixed alveolar and interstitial infiltrates suggesting an interstitial lung disease. In addition, a bronchoscopy with BAL revealed presence of importantly increased percentage of eosinophils (30%) in the lavage fluid. Based on the results of BAL, radiological features and her clinical course, she was diagnosed as potentially having an AEP-like syndrome related to clomipramine. Unlike patients with other eosinophilic lung diseases, most of the patients with AEP have normal peripheral blood eosinophil count (8). The level of total serum IgE can be elevated, however it is not used as a diagnostic tool (9). In this case, the patient had both normal peripheral blood eosinophil count and normal level of total serum Ig E. The diagnosis can easily be obtained with BAL and lung biopsy is not an obligation for the diagnosis of AEP in most cases. If needed, the purpose of lung biopsy is to exclude other diseases that can mimic AEP. When lung biopsy is performed, the histopathological features are characterized by diffuse alveolar damage with interstitial and alveolar eosinophils (10). There was no need for lung biopsy in this case and diagnosis could be established with the help of BAL cell count. In some cases discontinuation of the drug is enough for resolution of the radiological features. However, some patients experience a severe disease and require corticosteroid treatment. Generally, response to corticosteroids is rapid and most of the patients have significant clinical improvement within 24 to 48 hours. The optimal dose and duration of corticosteroids have not been determined exactly (8, 10). Commonly used doses of intravenous methylprednisolone in case series range from 60 to 1000 mg per day until respiratory failure resolves. Thereafter, the patient can be switched to oral prednisone, and the steroids can be tapered off over 2 to 12 weeks. In this case, 60 mg/day intravenous methylprednisolone was administered on admission and dose of the corticosteroid was regulated according to resolution of radiological findings. Corticosteroid treatment was terminated after 4 weeks. In conclusion, physicians should be aware of rare, life-threatening and treatable AEP-like syndrome because of clomipramine.

Introduced to a child

When we first are Introduced to a child, we have to assess them to understand which bevel of language we are going to use with them, we would not say to a 6 month old baby, ‘Hello, how are you, what have you been doing today, what would you like for dinner et. We must use lots of facial expressions and soften our tone of voice and use shorter sentences, we tend to speak slower as well so we say ‘Hellos' with a big smile on our face when speaking to a baby. If we are showing a baby something when we are speaking to them we should point also to help them understand what we are saying to them. Rhetorical questions are not real questions as the person asking the question as such, also answer it, so we might say to a baby would you like your nap now, Oh yes you would, you look very tired' or you would like your bottle of milk now, wouldn't you'. It allows us to speak and communicate with a baby or toddler who will not answer our questions but it is a way of us using speech, la nguage and communication on a daily basis, helping to be part of the day and feel involved.Using eye contact and smiling the response it usually positive and received back with a mile or babble. Closed questions should not be used all the time, only when a yes or no answer Is needed, we must ensure we still use all others areas through out the day, we can use a closed questions Like ‘have you finished your lunch' ‘do you need help with your shoes'. Closed question should not be used on babies, but can be used on young even able to shake or nod their head.Sometimes if a child is upset or does not know you (their first settling in), closed questions can be used to help if the child is feeling anxious and does not want to hold a conversation with you, obviously this is something you do not want happening every day and the child should start to speak and say words to you. Open questions prompt a child to give a longer answer and are needed to develop their speech and languag e skills.So asking questions like ‘what shall we do today' ‘what shall we have for lunch'. A child should not give a yes or no answer in open questions, but hopefully will speak up and answer the questions, sometimes you may et a ‘l don't no' answer, but that usually is due to others reasons. Babies will not be able to answer open questions and most of the time only children that feel comfortable with you, so the children that attend you setting for a while and are quite settled.

As Ming focused more closely on the water, he felt his previous contentedness give way to a sudden whirlwind of confusion. He blinked his eyes, stared again, and then quickly turned his gaze across the dome†¦ fifty yards away toward the mass of people celebrating in the press area. He knew they could not see him way over here in the dark. I should tell someone about this, shouldn't I? Ming looked again at the water, wondering what he would tell them. Was he seeing an optical illusion? Some kind of strange reflection? Uncertain, Ming stepped beyond the pylons and squatted down at the edge of the pit. The water level was four feet below the ice level, and he leaned down to get a better look. Yes, something was definitely strange. It was impossible to miss, and yet it had not become visible until the lights in the dome had gone out. Ming stood up. Somebody definitely needed to hear about this. He started off at a hurried pace toward the press area. Completing only a few steps, Ming slammed on the brakes. Good God! He spun back toward the hole, his eyes going wide with realization. It had just dawned on him. â€Å"Impossible!† he blurted aloud. And yet Ming knew that was the only explanation. Think, carefully, he cautioned. There must be a more reasonable rationale. But the harder Ming thought, the more convinced he was of what he was seeing. There is no other explanation! He could not believe that NASA and Corky Marlinson had somehow missed something this incredible, but Ming wasn't complaining. This is Wailee Ming's discovery now! Trembling with excitement, Ming ran to a nearby work area and found a beaker. All he needed was a little water sample. Nobody was going to believe this! 34 â€Å"As intelligence liaison to the White House,† Rachel Sexton was saying, trying to keep her voice from shaking as she addressed the crowd on the screen before her, â€Å"my duties include traveling to political hot spots around the globe, analyzing volatile situations, and reporting to the President and White House staff.† A bead of sweat formed just below her hairline and Rachel dabbed it away, silently cursing the President for dropping this briefing into her lap with zero warning. â€Å"Never before have my travels taken me to quite this exotic a spot.† Rachel motioned stiffly to the cramped trailer around her. â€Å"Believe it or not, I am addressing you right now from above the Arctic Circle on a sheet of ice that is over three hundred feet thick.† Rachel sensed a bewildered anticipation in the faces on the screen before her. They obviously knew they had been packed into the Oval Office for a reason, but certainly none of them imagined it would have anything to do with a development above the Arctic Circle. The sweat was beading again. Get it together, Rachel. This is what you do. â€Å"I sit before you tonight with great honor, pride, and†¦ above all, excitement.† Blank looks. Screw it, she thought, angrily wiping the sweat away. I didn't sign up for this. Rachel knew what her mother would say if she were here now: When in doubt, just spit it out! The old Yankee proverb embodied one of her mom's basic beliefs-that all challenges can be overcome by speaking the truth, no matter how it comes out. Taking a deep breath, Rachel sat up tall and looked straight into the camera. â€Å"Sorry, folks, if you're wondering how I could be sweating my butt off above the Arctic Circle†¦ I'm a little nervous.† The faces before her seemed to jolt back a moment. Some uneasy laughter. â€Å"In addition,† Rachel said, â€Å"your boss gave me about ten seconds' warning before telling me I would be facing his entire staff. This baptism by fire is not exactly what I had in mind for my first visit to the Oval Office.†
